Please read these Terms and Conditions carefully before purchasing any service from Digital Memorial Services. By placing an order, you agree to be bound by these terms. If you do not agree, please do not proceed with your purchase.
1. About Us
Digital Memorial Services is operated by AI Digi Hubs, a UK-based digital services business ("we", "us", "our"). Our registered address is in the United Kingdom. These Terms and Conditions govern your use of our website at digitalmemorialservices.co.uk and the purchase of our services.
2. Our Services
We provide the following services:
- Digital Memorial Websites — Bespoke 5-page memorial websites built to honour a deceased individual, hosted on a custom domain for the duration of your selected package.
- The Legacy Book — A professionally produced 6x9 inch printed book compiled from memorial website content, delivered physically to your specified address.
- Funeral Director Partnership — A white-label B2B service allowing funeral directors to offer digital memorials under their own brand.
3. Placing an Order
By placing an order on our website, you confirm that:
- You are at least 18 years of age
- You are legally permitted to purchase the service
- You have the authority and right to commission a memorial for the deceased individual named in your order
- All information you provide is accurate, complete and not misleading
- You have obtained the necessary permissions to use any photographs or content you provide
An order is accepted when payment is successfully processed and you receive a written confirmation from us. We reserve the right to decline any order at our discretion.
4. Pricing and Payment
All prices are displayed in pounds sterling (GBP) and include VAT where applicable. Prices are subject to change without notice, though any change will not affect an order already confirmed.
Payment is required in full at the time of ordering. We accept payment via Stripe (credit/debit card) and PayPal. All transactions are processed securely. We do not store card details.
For Funeral Director Partnerships, monthly subscription fees are charged in advance and will renew automatically unless cancelled with 30 days written notice.
5. Delivery Timelines
5.1 Digital Memorial Websites
- Essential package — Delivered within 5 working days of receiving complete memorial information
- Legacy package — Delivered within 48 hours of receiving complete memorial information
- Heritage package — Delivered within 24 hours of receiving complete memorial information
5.2 The Legacy Book
- Production begins upon receipt of your order and approval of the PDF proof
- Allow 3–5 weeks from order date to delivery, depending on your location and chosen edition
- We cannot guarantee delivery by a specific date unless this has been confirmed in writing by us
- Delivery timelines are estimates and may be affected by factors outside our control, including print partner capacity and Royal Mail or courier delays
Timelines begin from the date we receive your complete memorial information form, not the date of purchase. Delays in providing information will delay your delivery accordingly.
6. Your Responsibilities
You are responsible for:
- Providing accurate, complete memorial information in a timely manner
- Ensuring all photographs and content you supply are your own or that you have obtained the necessary rights to use them
- Ensuring content you supply does not infringe any third-party intellectual property rights
- Ensuring content you supply is not defamatory, offensive, illegal or otherwise inappropriate
- Reviewing and approving the PDF proof (for Legacy Book orders) within 5 working days of receipt
We are not liable for any delays caused by your failure to provide information, photographs or approvals in a timely manner.
7. Content Standards and Moderation
All content submitted to memorial walls is moderated before publication. We reserve the right to decline, remove or edit any content that we deem, in our sole discretion, to be:
- Offensive, defamatory, abusive or harmful
- False, misleading or fraudulent
- In breach of any applicable law
- Inappropriate for a memorial context
- In infringement of any third-party intellectual property rights
We do not guarantee that all submitted messages will be published. Moderation decisions are final.
8. Intellectual Property
8.1 Our Intellectual Property
All website design, code, templates, branding, email sequences, and other materials created by us remain our intellectual property. You are granted a limited, non-exclusive licence to use the memorial website for personal remembrance purposes only. You may not reproduce, distribute or commercially exploit our materials without our written consent.
8.2 Your Content
You retain ownership of all photographs, text and content you provide. By providing content, you grant us a non-exclusive, royalty-free licence to use that content solely for the purpose of building and displaying your memorial and/or Legacy Book. We will not use your content for any other purpose without your consent.
9. Hosting and Continuity
- Essential package — 12 months hosting included. Renewal required after 12 months.
- Legacy package — 2 years hosting included. Renewal required after 2 years.
- Heritage package — Lifetime hosting included. No renewal required.
We will contact you by email no less than 30 days before your hosting period expires. If you do not renew and we are unable to contact you, the memorial may be taken offline after a further 30-day grace period. We are not liable for the loss of any memorial data following expiry of the hosting period.
10. Refunds and Cancellations
10.1 Digital Memorial Websites
- You may cancel within 14 days of purchase for a full refund, provided we have not yet begun work on your memorial. Once work has begun, a partial refund may be offered at our discretion based on work completed.
- No refund will be issued once the memorial has been published live.
10.2 The Legacy Book
- You may cancel within 14 days of purchase for a full refund, provided we have not yet sent the PDF proof.
- Once the PDF proof has been sent, a 50% refund may be offered at our discretion.
- No refund will be issued once the book has been sent to print.
10.3 Defective Products
If your Legacy Book arrives damaged or defective, please contact us within 14 days of receipt with photographic evidence. We will arrange a replacement at no additional cost.
10.4 Consumer Rights
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
11. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for:
- Any indirect, incidental, special or consequential loss arising from your use of our services
- Any loss of data, including memorial content, following expiry of your hosting package
- Any delay in delivery caused by factors outside our control, including third-party print partners or postal services
- Any loss or damage caused by content submitted by third parties to the memorial wall
Our total liability to you in connection with any order shall not exceed the amount paid by you for that order.
12. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to natural disasters, pandemic, power failure, internet outage, third-party platform failure, or changes in law.
13. Funeral Director Partnership Terms
Funeral Director Partners agree to the following additional terms:
- The monthly subscription fee covers unlimited memorial deployments for client families
- Partners may present the service under their own brand but may not claim ownership of the underlying technology or templates
- Partners are responsible for obtaining appropriate consent from client families for data processing
- Partners may not sub-license, resell or transfer the service to any other party
- Either party may terminate the partnership with 30 days written notice
- Upon termination, existing client memorials will continue to operate for their remaining hosting period
14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Your continued use of our services after changes are posted constitutes your acceptance of the updated terms.
